California's SB 1050 makes advertisers disclose AI-generated performers from January
1 Jan 2027when disclosure becomes mandatory
Governor Gavin Newsom signed SB 1050, authored by Senator Angelique Ashby, at SAG-AFTRA headquarters. From 1 January 2027, any video or audio advertisement using a synthetic performer must say so, in prescribed words. A synthetic performer is a human-like figure or voice made wholly or partly by AI, and specifically not based on a real identifiable person. That last clause is the point. Deepfake laws protect a person from being copied. This one covers the actor who was never hired, because nobody needed to be. California is the second state to require it, after New York.
